    A relatively new pair of firearms present some very interesting legal issues given the current state of New York Law and just may fit into a loophole under existing New York gun laws.

    Mossberg Shockwave legal in New York Mossberg Shockwave The Mossberg Shockwave is a gun that has a barrel length of just over 14 inches and is a smooth bore no rifling.

    Its overall length is just over 26 inches and it has a magazine capacity of 5. This allows these guns to be sold and transferred without the paperwork tax stamp necessary to transfer guns that are subject to the NFA such as sawed off shotguns, silencers or fully automatic machineguns.

    New York gun laws are generally more strict limiting possession of far more guns than Federal Law does. The question is how would New York classify the Shockwave. Firstly, under New York Law the Shockwave is not a shotgun since a shotgun is a weapon designed or made to be fired from the shoulder. Clearly, the Shockwave, with its pistol grip is not designed to be fired from the shoulder. Similarly, the Shockwave is not a rifle.

    It is not designed or made to be fired from the shoulder. If it is a firearm, then one would need a license issued under Penal Law Article to own or possess it and would need to be registered. Under Penal Law The definition of pistol and revolver are not given in the penal law which generally means that we would use the ordinary definition of those words. Clearly, the Shockwave or Tac are not revolvers, they have no revolving cylinder or chamber.

    If so, while legal in New York, you would need a license to purchase one and it would need to be registered on your license. Would the New York authorities register such a weapon?

    The answer is that the Shockwave and Tac do not appear to be pistols. The definition of a handgun under New Jersey Law persuasive but not binding in New York requires that the gun be designed and manufactured to be shot with a single hand.

    The shockwave was specifically designed to be fired with two hands. A further examination of the definition of pistol on dictionary. Therefore, the Shockwave does not seem to fit the definition of a pistol. Lastly, a firearm under New York Law includes a shotgun with a barrel length of under 18 inches, a rifle with a barrel length of under 16 inches and either a shotgun or rifle with an overall length of under 26 inches. Since the Shockwave is not a shotgun nor a rifle see above these clearly do not apply.

    However the overall length is greater than 26 inches. In addition, I have heard people talk about the weight of this gun possibly violating the assault weapon ban in New York under the Safe Act but because the Shockwave is not semiautomatic it cannot be considered an assault weapon under New York Law.

    See Penal Law Please be aware that no Court has considered the issue in New York at this time but based upon the above, it appears that both the Shockwave and the Tac 14 are legal to own in New York.

You need a hand stop or a foregrip for safety on this thing unless someone makes a strap similar to the Mossberg Shockwave. Firing the gun slowly is safe, but trying to rapid fire, even with cheapo birdshot, is a bit dangerous because the gun jumps and bucks quite a bit.

    The Remington chucks the shells well away from the shooter, gotta love positive and consistent ejection. Buckshot is a little rougher. However, Fiocchi low recoil buckshot is more pleasant and way better suited for a gun this size. I installed a simple Magpul Mlok foregrip to the pump, and it helps you control the weapon and is legal to do. The grip attaches directly to the pump, without any rails required and this makes the weapon much more effective in my opinion.

    What is it Useful for? In reality, this is best suited as a range toy. An actual shotgun with a stock is much more effective as a fighting weapon. In an extreme close quarters situation, this gun is a bit more maneuverable than a standard shotgun, but a handgun would be a better choice. This is a very niche weapon for any kind of tactical use. Shooting is the purpose of this gun. I have a few. I think a foregrip or hand stop should be included with the gun.

    I also would like the receiver to be tapped for a scope mount. A red dot would be way better for accurately aiming this beast. Also, they added a sling swivel on the magazine tube cap but none of the Shockwave grip.
